Terms of Service for ClassBricks

Welcome to ClassBricks! These Terms of Service ("Terms") govern your access to and use of our website, classbricks.com, and our AI-driven SaaS solutions (collectively, the "Service"). The Service is owned and operated by ClassBricks, a sole proprietorship ("ClassBricks," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.

1. Eligibility and Accounts

• You must be at least 18 years old to use the Service.
• Our Service is designed for teachers and other educational professionals.
• You agree to provide accurate, current, and complete information during the registration process.
• You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately at support@classbricks.com of any unauthorized use of your account.

2. Subscriptions and Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

• Service Offerings: Our Service is offered on a "freemium" basis, which includes a Free Plan with limited features. Paid subscription plans provide access to additional features and products as described on our pricing page.
• Geographic Availability: Paid subscriptions are only available to customers outside the European Union (EU) and European Economic Area (EEA).
• Billing: Paid subscriptions are billed in advance on a recurring, auto-renewing basis (monthly or annually, depending on your selected plan).
• Payment Processing: All payments are processed securely by Paddle.com. We do not store your credit card information.
• Acceptance: By completing a purchase, you confirm that you have read and agree to these Terms of Service and our Refund Policy.
• Pricing: Current pricing and product details are available at classbricks.com/pricing. All prices are clearly displayed before purchase.
• Cancellation: You may cancel your subscription at any time through your Paddle customer portal. Your subscription will remain active until the end of your current billing period.
• If you experience technical difficulties with the portal, contact support@classbricks.com for assistance before your renewal date.
• The Paddle customer portal is available in multiple languages including English and Arabic, but Hebrew is not currently supported.

2.1 Product Access and Subscriptions

ClassBricks offers multiple products and subscription options:

• Individual Products: Access to specific standalone products
• Product Bundles: Discounted access to multiple products together
• Institutional Plans: Special pricing and features for learning centers and schools

Your subscription tier determines which products and features you can access. Product availability and bundle options are subject to change. For current offerings and detailed feature comparisons, visit classbricks.com/pricing.

If you subscribe to an individual product and later want to add another product, you may:

• Add the second product as a separate subscription, OR
• Switch to a bundle plan (which may require canceling individual subscriptions)

Bundle subscriptions cannot be partially canceled - if you cancel a bundle, you will lose access to all products in that bundle at the end of your billing period.

2.2 Pricing and Product Changes

We reserve the right to modify our subscription pricing, product offerings, and subscription plans at any time.

For Price Changes:

• We will provide at least 30 days advance notice via email before any price change affects your subscription
• Price changes will apply at your next renewal after the notice period
• If you do not wish to continue at the new price, you may cancel your subscription before your renewal date
• By continuing your subscription after receiving notice of a price change, you agree to pay the new price

For Product and Plan Changes:

• We may add new products, features, or subscription tiers at any time
• We may discontinue or modify existing products or features with 30 days notice
• If your current plan is discontinued, we will offer you a comparable alternative or the option to cancel
• Bundle pricing and multi-product subscriptions are subject to their own terms and pricing structures

Plan Transitions:

• You may upgrade or downgrade between plans at any time through your account settings
• Upgrades take effect immediately and you will be charged a prorated amount for the remainder of your billing cycle
• Downgrades take effect at the start of your next billing cycle
• Switching between individual products and bundles may require canceling your current subscription and starting a new one

3. Intellectual Property and Content

This section defines who owns what.

Our Service

We and our licensors exclusively own all right, title, and interest in and to the Service, including all associated software, AI models, and intellectual property rights.

Your Content

You retain any ownership rights you have in the text prompts you input into the Service ("User Content").

License from You to ClassBricks

By submitting User Content to the Service, you grant ClassBricks a worldwide, non-exclusive, royalty-free license to use, copy, modify, and create derivative works from your User Content solely for the purpose of operating, providing, and improving the Service, and to develop and train our artificial intelligence models. This license continues for as long as necessary to provide the Service and improve our AI models, including after you stop using the Service.

Generated Content

All content and materials generated by the Service in response to User Content ("Generated Content") are owned by ClassBricks.

License from ClassBricks to You

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the Generated Content for your professional educational purposes, including:

• Creating teaching materials for your own classes
• Using materials within your educational institution (subject to your subscription tier)
• Sharing with students in your educational setting
• Lesson planning and curriculum development

Restrictions on Use

You may not:

1. Resell, sublicense, or commercially distribute the Generated Content as a standalone product or service
2. Use the Generated Content in ways that compete with ClassBricks
3. Remove or alter any proprietary notices or attributions
4. Use Generated Content outside the scope of your subscription tier

4. Acceptable Use (Prohibited Conduct)

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You agree not to input any personally identifiable information about students or minors into the Service. ClassBricks is designed to create educational materials and does not require or permit the processing of student personal data.

You specifically agree not to:

• Use the Service for any illegal or fraudulent purpose.
• Generate, transmit, or store content that is harmful, hateful, discriminatory, obscene, or sexually explicit.
• Attempt to reverse-engineer, decompile, or disassemble the Service or its underlying models.
• Use any robot, spider, scraper, or other automated means to access the Service.
• Resell, sublicense, or otherwise transfer your right to use the Service to any third party.
• Interfere with or disrupt the integrity or performance of the Service.

5. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we determine you are located in a restricted territory.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Disclaimers and "As Is" Service

ClassBricks strives to provide a reliable and high-quality service, but it is offered on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

We do not warrant that: (a) the Service will be uninterrupted, secure, error-free, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the content generated by the Service is accurate, reliable, complete, or fit for a particular purpose. Your use of the Service is at your own sole risk.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall ClassBricks or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising from your use of the Service or any content obtained from it.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions.

9. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ClassBricks regarding our Service. If you have a separate, written agreement with us (an "Individual Contract"), the terms of that Individual Contract will prevail over any conflicting terms herein.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
